Terms of Use

1. Acceptance of these terms

These Terms of Use ("Terms") apply to your use of insanex.io and any pages, forms, quizzes and booking tools on it (the "Site"). The Site is operated by insaneX consulting Private Limited, doing business as insaneX ("insaneX", "we", "us" or "our").

By using the Site, answering the quiz, submitting the form or booking a call, you agree to these Terms. Our Privacy Policy explains how we handle personal information. If you do not agree to these Terms, please do not use the Site.

2. Who can use the Site

• You must be at least 18 years old.
• You must use the Site for business purposes, as a business owner, decision-maker or someone authorized to act for a business.
• The Site is not directed at children, and we do not knowingly collect information from anyone under 18.
• If you use the Site on behalf of a company, you confirm that you have authority to bind that company to these Terms.

3. What the Site is, and what it is not

The Site is a place to learn about insaneX's agency services and to request a free strategy call. Those services include paid ads, funnels, CRM, and email and SMS follow-up for SaaS companies, agencies and B2B service firms.

When you use the Site, you may answer a short quiz, submit your name, company website, email address and phone number, and book a call on our calendar.

• Using the Site, completing the quiz or booking a call does not create a client relationship or a service contract.
• Any paid services would be agreed separately with insaneX, in a written agreement signed by both parties.
• Refunds and cancellations for paid services are covered only by any separate agreement for those services.
• Completing the quiz or booking a call does not guarantee that we will accept you as a client. We may decline to work with any business at our discretion.
• Nothing on the Site is legal, financial, tax or investment advice.

You agree to give us information that is accurate and current. Please provide only a phone number and email address that belong to you or that you are authorized to use.

4. Consent to calls, texts and emails

When you submit our form, you agree that insaneX may call you and email you at the phone number and email address you provide. If you also tick the optional text box on the form, you agree that insaneX may send you text messages (SMS) at that number. These messages relate to your request and may include:

• booking confirmations and reminders;
• follow-up about your quiz answers, your strategy call and your business needs; and
• follow-up about your request, such as information about the services you asked about.

We do not send promotional or bulk marketing texts under this consent. Our texts are only about your request.

Texts may be sent using automated technology.

You do not have to agree to receive texts in order to buy anything from us. Consent is not a condition of purchase. The text box is optional and unticked, and the form works without it. A phone number is required to book a strategy call, because we use it to call you about your request.

Text message terms

• Message frequency varies, based on your request and your booking.
• Message and data rates may apply, depending on your mobile plan.
• Reply STOP, END, CANCEL, UNSUBSCRIBE or QUIT at any time to opt out of texts. You will get one confirmation message, and then no more texts.

• Mobile carriers are not liable for delayed or undelivered messages.
• We do not share mobile information with third parties or affiliates for marketing or promotional purposes, and we do not share text-message opt-in data or consent with any third parties. See our Privacy Policy.

How to stop messages

• Texts: reply STOP, as described above.
• Emails: use the unsubscribe link in any email, or write to us.
• Calls: tell us on the call, or write to us.
• Any other reasonable way: you can revoke your consent in any other reasonable way, such as by email or on a call.

We will honor your request as soon as possible and within 10 business days. If you revoke consent to automated texts or calls, we will stop all automated texts and calls to that number.

How we handle your information is explained in our Privacy Policy.

5. Results and figures are not guarantees

The Site may show figures such as revenue generated, return on ad spend (ROAS) and calls booked. Figures shown on the Site describe specific past client results.

• Individual results vary and are not guaranteed.
• Past results do not predict future results.
• They are not a promise, forecast or guarantee of what you will achieve.
• Results depend on many things, including your offer, your market, your budget, your sales process and how well the work is carried out.

We do not guarantee any particular amount of leads, sales, revenue, return or growth. Do not rely on any figure on the Site as a guarantee when making business decisions.

6. Intellectual property

The insaneX name, logo, designs, text, graphics, quiz, page layouts and other content on the Site belong to insaneX consulting Private Limited or its licensors and are protected by intellectual property laws.

• You may view the Site and print or save pages for your own internal business use.
• You may not copy, reproduce, modify, distribute, republish, sell or create derivative works from the Site or its content without our written permission.
• You may not use the insaneX name or logo in a way that suggests we endorse or are affiliated with you or your business, without our written permission.

If you send us feedback or ideas, you agree that we may use them without owing you payment or credit. This does not give us any right to your confidential business information that you share in the course of any separate agreement for paid services.

7. Acceptable use

You agree not to:

• break any law or regulation, or use the Site for any unlawful purpose;
• submit false, misleading or fraudulent information, or use another person's identity or contact details;
• submit contact details for someone else without their permission;
• submit spam, bulk or automated entries, or use bots or scripts to fill in the form or book calls;
• attempt to gain unauthorized access to the Site, our systems or other users' data;
• introduce viruses, malware or any code that could harm or disrupt the Site;
• probe, scan or test the security of the Site, or overload it with traffic;
• scrape, harvest or copy the Site or its content at scale; or
• use the Site to compete with us, or to build a similar product or service from our content.

We may block access, remove submissions or cancel bookings if we believe you have broken these rules.

8. Service providers, advertising tools and links

We use service providers to run the Site. They process your information for us, and we remain responsible for how we use it, as described in our Privacy Policy.

• GoHighLevel (LeadConnector) provides our CRM, calendar booking, email and SMS sending.
• Google Workspace handles our email.
• Hostinger hosts the Site.
• Google Fonts: the Site loads fonts from Google servers, so Google receives your IP address and browser details when a page loads.

Advertising tools

The Site is set up to use the Meta Pixel, but it is switched off today, so no Meta Pixel runs on the Site. We do not use the Meta Conversions API. If we switch the Meta Pixel on, it will not load in browsers that send a Global Privacy Control signal. When it runs, it sends Meta Platforms information about your visit and actions on the Site, such as:

• pages viewed, and quiz and form events, including the business type you choose;
• URL parameters and click IDs;
• your IP address, and device and browser data; and
• cookie identifiers, such as _fbp and _fbc.

Meta uses this for ad measurement and to build advertising audiences, and handles it under its own privacy policy. We do not send your name, email address, phone number or text-message opt-in or consent records to Meta or any other advertising partner.

We do not use Google Analytics or Google Ads on the Site today. We may add them later, and if we do, we will update these Terms and our Privacy Policy.

Under California law, these tools count as "sharing" for cross-context behavioral advertising when they run. To opt out:

• use the Your Privacy Choices link in the footer of every page;
• send a Global Privacy Control signal from your browser;
• follow the opt-out steps in our Privacy Policy;
• change your Meta ad settings at facebook.com/adpreferences; or
• if we use Google Analytics, install the browser add-on at tools.google.com/dlpage/gaoptout.

We do not show a cookie banner today, because the Site does not set advertising cookies. If we switch on advertising tools, visitors in the UK, EU and other regions that require consent will be asked before advertising cookies are set.

Links to other sites

The Site may link to other sites we do not control. We are not responsible for their content or practices.

9. Privacy

Our Privacy Policy explains what we collect, why we collect it, who we share it with, and the choices you have. The Privacy Policy is a notice about our data practices. It is not a contract term and does not ask for your consent to processing.

10. No promises about the Site

The Site and its content are provided "as is" and "as available". To the fullest extent the law allows, insaneX makes no promises of any kind about the Site, whether stated, implied or set by law. For example, we do not promise that the Site:

• is of merchantable quality or fit for a particular purpose;
• is accurate;
• does not infringe anyone else's rights; or
• will run without interruption or errors.

We do not promise that the Site will always be available, secure or free of harmful components, or that the content is complete, current or suitable for your situation.

11. Limits on what we owe you

To the fullest extent the law allows:

• We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages.
• We are not liable for lost profits, lost revenue, lost data or lost business opportunities.
• These limits apply to any claim about your use of the Site, even if we were told such losses were possible.
• Our total liability for any claim about the Site or these Terms will not exceed US$100.

In this section, "we" means insaneX, insaneX consulting Private Limited and our owners, officers, employees, contractors and agents.

These limits apply to the Site and these Terms only. Any separate agreement for paid services governs those services.

Some laws do not allow these limits. Where that is the case, the limits apply only as far as the law allows. We never limit our liability for fraud, or for death or personal injury caused by negligence.

12. If your actions lead to a claim against us

If someone makes a claim against us because of any of the things below, you agree to cover it. That means defending us and paying any resulting losses, damages, costs and reasonable legal fees (in legal terms, you agree to defend, indemnify and hold us harmless). "Us" here means insaneX, insaneX consulting Private Limited and our owners, officers, employees, contractors and agents. The things are:

• your breach of these Terms;
• information you submit through the Site, including any contact details you did not have the right to give us; or
• your violation of any law or the rights of any other person.

If the law where you are located limits this promise, it applies only as far as that law allows.

13. Which law applies and where disputes are heard

The laws of the State of Texas, United States, govern these Terms and any dispute about them or the Site. This applies even if another place's law would normally apply.

Any such dispute can be brought only in the state or federal courts located in the State of Texas. You and insaneX both agree to have the case heard there.

If you are located outside the United States, this section does not remove any rights you have under mandatory consumer or data protection laws where you live, to the extent those laws apply to you.

14. Changes to these terms and to the Site

We may update these Terms from time to time. When we do, we will post the new version on this page and change the effective date at the top. Changes apply from the date they are posted. If you keep using the Site after that, you accept the updated Terms.

Changes to these Terms will not expand the types of calls or texts you have agreed to receive, or how we use your mobile information, unless you give new consent.

We may also change, suspend or remove any part of the Site at any time, without notice.

15. How these Terms work together

• Entire agreement. These Terms are the whole agreement between you and insaneX about your use of the Site. They do not replace any separate agreement for paid services. The Privacy Policy is a separate notice, not part of this agreement.
• If one part is invalid. If a part of these Terms is found unenforceable, the rest stays in effect.
• No waiver. If we do not enforce a right, that does not mean we give it up.
• Transfer. You may not transfer your rights under these Terms. We may transfer ours, for example in a business sale or reorganization.
